Terms & Conditions.

Booking CONDITIONS

1. Please note the following and read carefully. The Booking Conditions together with our literature describing your holiday components and the general information contained in this web site will form part of the holiday contract between www.stayholidays.com ("us") and the person who booked the holiday ("you") and all party members going on holiday with you.
In these Booking Conditions, "you" and "your" means the first named person on the booking. References to your "holiday" mean the property, travel and other services, as applicable, booked and paid for through www.stayholidays.com. Any contract to hire a property on our website or via our authorised third party sales agents, is between the holiday home owner and you as the hirer. www.stayholidays.com ("we") are agents for the property owners (the "owner") and not principals. The contract does not take effect until we dispatch a written confirmation or email to you. www.stayholidays.com also acts as agents for companies and other service providers mentioned in this web site ("Service Provider(s)").

2. YOUR BOOKING
You should be 18 years or over when you make your booking. When we on behalf of the Owner/ Service Provider(s) issue a written confirmation or email to you, this signifies that the Owner/Service Provider(s) has entered into a contract with you, which is subject to these Conditions. www.stayholidays.com on behalf of the Owner/Service Provider(s) has the right to refuse any booking prior to the issue of your written confirmation or email, even if monies have been paid and banked. As soon as your confirmation or email is received, you should check the details carefully. If anything is not correct you should tell us immediately. If you have any special request, disabilities or health problems you should advise us at the time of booking and clearly confirm it in writing or by acknowledged email and it will be noted on the confirmation form. No guarantees are given that any request will be met. Failure to meet any special request may not be a breach of contract.

3. PAYING FOR YOUR HOLIDAY
When you book you should pay the amount then due by debit/credit card online. Your full balance payment is due at the time of booking. If the balance is not received for any reason, www.stayholidays.com shall be entitled to enforce cancellation conditions see clause 4(ii). If we have to contact you for payment for any reasons, a charge of €20 will be made for every contact made.
Hire terms include all relevant taxes in force at the time the web site was published. They are subject to change if the appropriate rate alters. Prices of any item on our web site may be increased or decreased at any time without notice. Changes and errors occasionally occur in both advertised, published and confirmed prices, hence you should check all details of your chosen holiday (including the price) at the time of booking. Supplements may be charged by the owner at the time of arrival. While we make best effort to inform you prior to booking, we are not and do not accept responsibility for such charges.

4. AMENDMENTS OR CANCELLATION BY YOU
You are subject to the standard conditions of all our service provider(s). Copies of their booking conditions are obtained from them or us upon request .
(i) Amendment
Amendment fees range from €10 - €25 may be charged where appropriate for a change made to a booking together with costs or charges incurred or imposed by the Owner and/or any Service Provider(s) (see section14).
(ii) Full Cancellations
The party leader should immediately confirm your cancellation in writing or by acknowledged email ("letter") sent by recorded delivery to www.stayholidays.com. Cancellation takes effect from the day we receive the letter or email. The following cancellation charges will apply. Insurance premiums or booking fees are not refundable.
CANCELLATION CHARGES
No. of days before arrival date that notification of cancellation is received in writing or by acknowledged email:
More than 60 days: Full deposit.
30-60 days: 50% of total holiday cost.
Less than 29 days: No Refund.

Any Refund given is given at our discretion and may be subject to administration charges.

5. AMENDMENTS OR CANCELLATION BY US OR BY THE OWNER/SERVICE PROVIDER(S)
We will endeavour not to make changes to your booking or to cancel it, but sometimes before and after booking confirmation, changes outside our control occur and bookings have to be changed or cancelled or errors in web site or other details corrected. The Company, Owners and Service Provider(s) reserve the right to do so. We cannot offer compensation for minor or significant changes nor for any change or cancellation resulting from "force majeure" or where you have refused without good reason to accept an alternative property you have been offered. Very rarely, the Company may be forced by "force majeure" to change or terminate your holiday after departure but before the scheduled end of your time away. This is extremely unlikely but if this situation does occur, the Company regrets it will be unable to make any refunds (unless the Company obtains any refunds from the Owner or Service Providers), pay you any compensation or meet any costs or expenses you incur as a result.

6. FORCE MAJEURE
Force Majeure are circumstances beyond the control of the Owner/Service Providers/the Company. In these Booking Conditions "force majeure" means any event which we or the supplier of the services in question could not even with all due care foresee or avoid.We regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations, or those of property owners or service providers, is prevented or affected by or you otherwise suffer any damage or loss as a result of "force majeure".

7. WEB SITE
We take due care and do everything we reasonably can to ensure that the information provided by Owners and Service Providers is accurately and completely conveyed in the web site and other promotional literature or material produced and circulated by us. As soon as we become aware of any changes, we will always tell you as soon as possible, if we think your holiday is likely to be affected. Owners, Service Providers and the Company cannot accept responsibility for any changes or closures to area amenities or attractions mentioned in the web site, by the Company’s Holiday Advisers or advertised elsewhere. All distances are approximate. This web site and the prices and booking conditions it contains supersede all previous editions. Subsequent editions may supersede prices and booking conditions in this web site and the website will contain the most up to date information to date.

8. YOUR LIABILITY AND THE PROPERTY
Local laws and standards apply to any services that make up your holiday in the country in which they are provided.
The property may not be occupied before 16:00 hrs (4 p.m.) on the rental start date unless prior permission has been obtained from the owner. The property should be vacated by 10:00 hrs (10 a.m.) on the final day of the rental and left in a clean condition. You should contact the owner/caretaker no later than 48 hours before the holiday start date to finalise all arrival details, including agreed arrival time and key collection. You should advise the owner/caretaker of any travel delay the moment you become aware of it so that suitable arrangements can be made. If you do not follow the above procedure and fail to gain access to the property, you will be fully responsible for all costs and associated costs of any temporary accommodation, or other temporary arrangements made, until you can gain access to the property. You agree both to keep the property clean and tidy and to leave the property in a clean condition on the final day. A charge will be made if additional cleaning is required. You and all members of your party further agree not to use the property for any commercial purpose, including without limitation assigning or subletting it. You undertake to pay all extra charges as incurred and shall indemnify www.stayholidays.com against any damage or loss caused by yourself or any party member. You are responsible to the Owner for the actual costs of any breakage or damage in or to the property along with any additional costs that may result/ which are caused by you and/or any members of your holiday rental party, and the Owner can require payment from you to cover any such costs. The Owner is entitled at his/her sole and absolute discretion to refuse to hand over to you or to repossess the property, if the Owner reasonably believes that any damage is likely to be caused, has been caused or is being caused by you or any members or your party. The total number in the party should not exceed the number stated for any particular property as detailed in the web site, unless prior consent has been obtained. If this is disregarded the owner reserves the right to terminate the rental without notice and the booking is treated as a cancellation by you. No refund of any monies you have paid in respect of your booking will be made and neither the Owner nor the Company will have any liability to you as a result of this situation arising (including e.g. any costs or expenses incurred due to not being able to occupy the property, such as the cost of securing an alternative property/accommodation). In this situation, neither the Owner nor the Company is under any obligation to find any alternative accommodation for you. You should allow the Owner and any representative of the Owner (including workmen) access to the property at any reasonable time during your occupation of the property. In cases of emergency or where a problem needs remedying quickly and you cannot be contacted in time the Owner is entitled to enter the property at any time without giving you prior notice.


9. PETS
You agree to abide by all local laws, quaratines etc in relation to pets. Pets are only allowed at properties that state they are allowed in the web site. If you take a pet into a property that does not allow them, or you exceed the stated number/size of pets, the Owner/Caretaker reserves the right to terminate the rental without notice. In such an event the booking will be treated as a cancellation by you. Pets are not allowed in bedrooms, in the bath/shower, on furniture, or in any communal facilities, such as swimming pools or shops. Pets should not be left unattended in the property. Dogs should be kept on a lead within the boundaries of a property including the garden. It is your responsibility to clean up after your pet.

10. OUR LIABILTY
The Owner, Service Provider(s) and www.stayholidays.com shall have no liability for (a) any death or personal injury, (b) loss of or damage to, personal effects, baggage, vehicle, or any other item belonging to you or any other party member.

It is your responsibilty to ensure that you are adequately insured for such events and agree to be so insured prior to entering any property booked through us.

11. DISSATISFACTION
If you are not entirely satisfied with the accommodation offered, you should contact the owner or their representative immediately and attempt to resolve the problem on site during the holiday. This is very important, as it gives the owner or their representative the opportunity to understand the nature of your concern, and respond quickly and effectively. This applies particularly to complaints of a transient nature, (e.g. cleanliness or heating) as these cannot possibly be investigated unless registered with the Company during your holiday. Where it is not possible to resolve the concern locally, you should contact www.stayholidays.com by email or telephone. immediately during your holiday. Should you ring outside office hours or during office hours and all lines are engaged, then a 24 hour answer machine operates in which instance you should leave clear details of your name, contact phone number, booking reference number and/or your home post code and a brief message. If after that you still feel that the problem has not been resolved to your satisfaction, you should within 7 days of the end of the rental period put comments in writing or by acknowledged email to the Company. These need to include your Booking Reference, full details of your complaint or claim and, in the case of injury or illness, enclosing a letter or email from your doctor. The Company should be given the opportunity to rectify a situation. Please help the Owner, Service Provider(s) and the Company to help you by following this procedure.

12. DISABLITIES AND MEDICAL PROBLEMS
If you or any member of your party has any medical problem or disability that may affect your holiday please give the Company full details before you confirm your booking in writing or by acknowledged email. The Company endeavours to accommodate the particular needs of the person concerned. No guarantees are given that any request will be met. Failure to meet any special request will not be a breach of contract. See booking condition (2).

13. PASSPORTS, VISAS AND HELATH REQUIREMENTS
If you are travelling from other countries, or are not a Irish/British Citizen, you should check withyour local Irish Embassy. If you travel by car you require your valid driving license. Information on health is contained in the Department of Health available from your local Department of Health office and most Post Offices. The European Community (EC) reciprocal health care arrangements apply to Ireland. Only state-provided treatment is covered and may not cover all of the things that you would expect free of charge from your own health provider. If you are taken ill or have an accident, free or reduced-cost necessary treatment is available. You should contact the Health Board of the area where you are staying otherwise the service will not be free of charge. For absolute peace of mind we strongly recommend full and comprehensive personal insurance cover.

14. DATA PROTECTION
For the purposes of the Data Protection Act 1998, www.stayholidays.com and www.paypal.com are the sole data controller of all personal data provided to us by customers and prospective customers. We are not responsible and accept nop responsibilty for the paypal provided services on our web site. Should you have concerns please email us for further information.

15. CONDITIONS OF SERVICE PROVIDERS
The services which make up your holiday are provided by persons, firms, companies and other bodies which are wholly independent of the Company and for whom the Company acts as agents. Copies of the relevant parts of these terms and conditions are available on request from the Company or the Service Provider concerned.

16. PERSONAL HOLIDAY INSURANCE
You will be strongly advised to obtain personal travel insurance for your holiday. See point 13. Insurance premiums should be paid at the time of booking, as cover will not be effective until we receive all applicable premiums in full.

17. YOUR FINANCIAL PAYMENTS.
When you book your holiday withwww.stayholidays.com your money is processed using www.paypal.com. www.stayholidays.com does not have access to any credit card details. All credit card processing is handled by paypal which is a well recognised funds processor and adheres to strict security standards. Should you have any concerns about your financila details please email us or contact paypal directly.

18 . ADVERTS.
One item per advert - one advert per item. Do not list multiple items in a single advert.www.stayholidays.com reserves the right to revise or reject for any reason at its sole discretion any advertising copy submitted.

All advertising materials, including photographs, submitted by the advertiser become the property of www.stayholidays.com and may not be reproduced from it's website for use in other publications, websites, or any other medium without the written consent of www.stayholidays.com

www.stayholidays.com's liability for damages resulting from errors in any advertising that it publishes or from its failure to publish any advertisement that it has agreed to publish shall be limited to the amount it actually received in consideration for its agreement to publish the advertisement in question.

The Advertiser shall keep confidential all usernames, passwords, security identification or encryption details relating to it's service. User access details shall under no circumstances be shared with any third party.

The Advertiser accepts all liability for the content of all advertising he or she places for publication. Advertiser warrants to www.stayholidays.com that advertising copy is true, that it is not libelous or defamatory, that it violates no rights of privacy, that it infringes no trademark, and that it complies with all applicable national and international laws and regulations. The Advertiser agrees to defend, indemnify and hold harmless www.stayholidays.com from any and all claims, demands, liabilities, suits, costs, or expenses, arising by reason of the publication of the Advertiser's advertisement or breach of the foregoing warranty, whether such claims are well-grounded or not.

www.stayholidays.com may at any time remove any or all materials from it's system which in www.stayholidays.com's opinion are illegal or have been placed on it's servers in breach of these terms and conditions.

www.stayholidays.com may at any time vary the technical specifications of the service for operational reasons. From time to time, www.stayholidays.com will require to carry out maintenance on its equipment and systems, and shall use its reasonable endeavours to ensure that in doing so minimum disruption to service availability is caused.

www.stayholidays.com reserves the right to make modifications to service design, layouts and logic which in its sole discretion benefit the overall functionality and efficiency of it's service.

The Advertiser shall not upload to it's system any files that are virus infected, corrupted or in any file format not explicitly stated as approved for upload.

The Advertiser shall notify www.stayholidays.com of any faults in it's system as soon as the faults come to the Advertiser's attention.

www.stayholidays.com does not monitor or control and shall not be responsible for the content of any messages delivered to the Advertiser through it's service. The Advertiser is directly responsible for the publication of telephone, email and other personal contact details. The Advertiser agrees that the publication of this information is entirely at the Advertiser's discretion.

Neither party shall be required to perform any term or condition so long as such performance is delayed or prevented by force majeure, including acts of God, strikes, lockouts, material or labour restrictions by any government authority, civil riot, floods, and any other cause not reasonably within the control of the performing party and which, by due diligence, such party is unable, wholly or in part, to prevent or overcome.
